Brookline Industries Limited Warranty

Brookline Industries, (the "Company") warrants that its products sold under the Brookline® trade name are free from defects in materials and workmanship under normal service and use. This warranty does not cover defects or damage arising from improper installation, improper maintenance or lack of maintenance, improper storage, shipping and handling, ordinary wear and tear, misuse, abuse, accident, unauthorized service, use with unauthorized Non-Brookline products or parts, or the effects of erosion, or corrosion on the finish. This warranty is void if any modification is made to the product, outside of the Seller's plant, regardless of whether the modification causes or contributes to the alleged defect. All modifications are made at the risk of the party making the modification. The only liability of the Company in tort or contract whether under this warranty or otherwise shall be limited to the repair or replacement of any product or component part which shall prove defective as covered by this warranty. This warranty shall neither extend to nor cover any labor charges for replacement of products or parts, adjustments, or repairs, or any other work, which costs shall be the sole responsibility of the the Buyer. In no event shall the Seller be liable to the Buyer or any other party for, and the Buyer waives, any and all other damages ,including, without limitation, incidental, special, indirect, collateral, punitive or consequential damages, including, without limitation, loss of profits, or loss of use damages or downtime costs. This warranty is extended only to The Seller's distributors of its products and the first end user who purchases products for purposes other than resale (collectively, "The Buyer"). The warranty period after delivery to the original purchaser in all cases is as set forth In the table below:

Written notice of a product or component part believed to be defective as covered by this warranty should be sent to:

Brookline Industries, 1624 South Clinton Street, Chicago, IL 60616 USA

and should include your name, company name and/or facility name, and address, an identification of the product or component part and a brief description of the defect. Upon receipt of such notice, the Company will inform you where to ship such product or component part, shipping charges prepaid by the Buyer, for examination and, in the event such examination reveals a defect covered by this warranty, the product will be repaired or replaced.
THIS WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES. TO THE EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES ARE LIMITED TO THE DURATION OF THIS WARRANTY. BROOKLINE MANUFACTURING. SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
